Paradise Valley Elementary School Sexual Abuse Lawsuit

Attorney Robert Allard has filed a lawsuit against The Morgan Hill Unified School District on behalf of one of the victims molested by a fifth-grade teacher. Specifically, Mr Allard stated that Paradise Valley Elementary School failed to recognize obvious predatory behavior. "When you walk by a classroom," stated Allard, "and the windows are blocked and the teacher is in there with a child, and the door is locked, wouldn't you ask yourself 'why is he doing that?'" As a result, the victim is claiming negligence and breach of mandatory duty in a complaint for damages filed in Santa Clara County Superior Court.

Due to the sexual abuse of four fifth-grade girls, John Loyd has been sentenced to 40 years in prison. Consequently, the case has prompted the victims' parents to seek legislative reform. California educators, parents believe, should be taught how to recognize predatory behavior. After pleading no contest to four felony counts of lewd or lascivious acts on a child by force, violence, duress or fear, Santa Clara County Superior Court Judge Edward Lee sentenced Loyd in a Morgan Hill courtroom.

A government claim has been filed by the law firm of Cerri, Boskovich & Allard with the Morgan Hill Unified School District to protect a sex abuse victim’s right to sue the district over sexual abuse committed by Paradise Valley Elementary School teacher John Loyd. 11-year-old Jane Doe has been identified as the victim. John Loyd has agreed to a prison sentence of 40 years, rather than face a criminal trial and the possibility of a life term, the maximum sentence which the charges would allow.

Paradise Valley Elementary School Sexual Abuse Case - Teacher Arrested

The Paradise Valley Elementary School sexual abuse case involves a fifth-grade teacher at the Morgan Hill-based school. After he was arrested, the teacher, John Arthur Loyd, is now facing child molestation charges. According to police reports, Loyd allegedly sexually assaulted a girl numerous times inside his classroom.

Also, at Paradise Valley Elementary School, former child care worker Nicolas Lhermine allegedly sexually assaulted four young children. He did so while working for the school-based Morgan Hill Mt. Madonna YMCA child care program.

The law firm of Cerri, Boskovich & Allard represents the four children and their families in a civil lawsuit against the YMCA of Silicon Valley, the parent organization of the Morgan Hill Mt. Madonna YMCA. The YMCA of Silicon Valley is responsible for the administration of 12 Association Centers in the area including the Mt. Madonna YMCA. These entities operated the YMCA - Paradise Valley summer child care camp on the premises of Paradise Valley Elementary School.

Mandated Training and Reporting

After new legislation was signed in California, Loyd's arrest came days later. This legislation mandated that all California teachers and school employees receive annual child abuse reporting training.

However, in 2013, a Bay Area News Group survey found that less than half of the 94 Bay Area school districts trained their employees on the identification and reporting of child abuse.
